Default Insurance / LLC questions

I am getting prepaired for next year. I will be getting layed off again in the spring (if not sooner) and have finally decided to be my own boss.

When I start next year, am I able to purchase insurance and not be LLC or do I need both? I am wanting this to be as ligit as possible so if there is any suggestions I am all ears.

You do not need to be an LLC to purchase insurance. However, if you are a sole proprietor all the liability falls back on you. I am not a lawyer, so please seek legal advice.

05monte,

Insurance is easy to get. The first thing you want to do is go register your an assumed name (business name) at your county clerk's office. You will need to have that in order to open up a business account at the bank and to buy liability insurance for your business. I would also recommend that when you take out a liability policy, you get a rider on it to protect your equipment from theft or damage. Equipment gets stolen a lot off of rigs.

Check with an agent that handles commercial insurance. You should be able to find them easily in the yellow pages. The insurance is pretty reasonable as well. I carry $100,000 in liability and again my equipment is covered for about $500 a year.

Default Family Limited Partnership

If you want to protect your assets a Family Limited Partnership is the way to go. It has superior protection against lawsuits. In any legal lawsuite the only thing that matters is what the state by laws says. This is what is called the "CHARGING ORDER". They are great tools to protect yourself, in fact most attorneys once they find out about them they will want to settle ASAP because they cannot prevail that much because they are limited to the amount they can receive for their client. Even the IRS hates them.

Get all the info by doing a search of this famous attorney Jay Mitton.

If you want to buy an insurance, look for the services that they offer, the benefits, and the cost. I used to insure my business at allstate. I've used it for almost 2 years but it didn't work. And they give high quotes. I switched to http://www.oneshopinsurance.com they're like brokers. I am using oneshopinsurance for almost 3 years.
