Default Name Question

If someone had " A Forever Green Lawn Care LLC " and I wanted "Forever Green Landscaping" would I be able to do that? just wondering because the names are almost alike and I don't want any legal trouble. Thanks everyone for taking time and trying to help me out.

Check with your local City Hall, you'll probably have to register it with them anyway.

That could be a tricky one. In the the state of NJ it is written on the books that no two services may use the same name in the same servicing juristiction for instance all american reposession could be bank only towing while all american towing could do AAA calls all day. a general rule of thumb in that instance all though not always is to look in the phone book if they are under lawn care and not landscaping then maybe if they are under both you could be biting off a bigger chunk than you can chew. My closest competitor is a J&J landscaping. he tried to say the name was his solely even though i am JMJ Lawn and Landscape

1 we are different juristictions safe for me
2 we provide an additional service
3 the term landscaping in general carries alot more in relative services from planting to retaining walls to pavers. so be careful about your terminology.

It is my personal opinion if you are a sole proprietor that it is more benefitial for you not to get involved by even being close. Even green forever could be taken backward and flipped and used against you. Why give some guy a reason to strike out at you? Think of it this way he can always make up an excuse to say he's taking my business under my name i want XXX in damages (if he is ailing in business). Or if he damaged something and you are established anyone forgetting his name could accidentally mistake it for you
